What happened

Landlord applied for an order to terminate the tenancy and evict the Unauthorized Occupant, and for compensation for the use of the rental unit. The Tenant transferred the occupancy of the rental unit to the Unauthorized Occupant in a manner that was not authorized by the Residential Tenancies Act, 2006.

The ruling

The tenancy between the Landlord and Tenant is terminated as of February 2, 2020. The Unauthorized Occupant shall move out of the rental unit on or before May 31, 2021 and pay the Landlord $19,653.58 in compensation for use of the unit from February 2, 2020 to April 26, 2021, plus $46.95 per day from April 27, 2021 until move-out, and the $190 application fee. If the Unauthorized Occupant does not pay the full amount by May 31, 2021, they will owe interest at 2% starting June 1, 2021.
