What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant has knowingly misrepresented the Tenant's income or the income of other members of the Tenant's family who occupy the unit. The Landlord also applied for an order to terminate the tenancy and evict the Unauthorized Occupant, who is the Tenant's spouse, and for compensation for the use of the rental unit.

The ruling

The tenancy between the Landlord and the Tenant is terminated. The Unauthorized Occupant must move out of the rental unit on or before November 20, 2022. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Unauthorized Occupant must pay the Landlord $35,000.00 for the occupation of the rental unit and $201.00 for the cost of filing the application, for a total of $35,201.00. If the Unauthorized Occupant does not pay the full amount by November 20, 2022, they will start to owe interest at 4.00% annually on the outstanding balance.
