What happened

The Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The application was about the elevators in the residential complex.

The ruling

The Landlord failed to maintain the elevators in a good state of repair and comply with safety and maintenance standards, in breach of section 20 of the Residential Tenancies Act, 2006. The Tenants are entitled to rent abatements for the period of March 27, 2013 to November 18, 2013 based on the impact of the breach on individual Tenants.
