What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to meet a condition specified in a previous LTB order. The previous order required the Tenant to pay $423.25 towards rent arrears by December 20, 2022, which the Tenant did not do.
The ruling
The tenancy is terminated effective March 28, 2023. The Tenant must pay the Landlord $4,436.78 less any payments made on or after December 21, 2022, representing rent arrears and the cost of the previous application. The Tenant must also pay the Landlord $35.34 per day for compensation for use of the unit starting March 18, 2023 until the Tenant vacates. If the Tenant does not pay the full amount owing by March 28, 2023, the Tenant will start to owe interest at 5% annually on the outstanding balance.
