What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid rent from April 1, 2020 to February 28, 2021.
The ruling
The tenancy was terminated effective February 21, 2021. The Tenants were ordered to pay $12,526.88 to the Landlord, which includes rent arrears up to February 10, 2021, less the rent deposit and interest owed on the deposit. The Tenants were also ordered to pay $55.44 per day in compensation for use of the unit from February 11, 2021 until they vacate, as well as the $186 application fee. If the full amount is not paid by February 21, 2021, the Landlord may file the order with the Sheriff to enforce the eviction.
