What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Tenants had vacated the rental unit on February 20, 2021, after being served with an N8 Notice of Termination effective April 30, 2020.
The ruling
The tenancy between the Landlords and the Tenants is terminated as of February 20, 2021, the date the Tenants gave vacant possession of the rental unit to the Landlords. The Tenants shall pay the Landlords $22,327.38, which represents compensation for the use of the unit from May 1, 2020 to February 20, 2021, less the rent deposit and interest the Landlords owe on the rent deposit. The Tenants shall also pay the Landlords $175.00 for the cost of filing the application. If the Tenants do not pay the full amount owing by May 14, 2021, they will start to owe simple interest calculated at 2.00% annually on the balance outstanding.
