What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant David Given was no longer in possession of the rental unit due to a restraining order, but the Landlord disputed that he is no longer a tenant.
The ruling
The tenancy is terminated unless the Tenant pays $13,216 by April 30, 2024 or $15,471 by May 31, 2024 to void the order. If the Tenant does not void the order, they must pay $6,806.78 to the Landlord and vacate the unit by May 31, 2024. The Tenant will owe daily compensation of $74.14 for each day of occupation after March 6, 2024.
