What happened

Tenant applied for an order determining that the Landlord gave a notice of termination in bad faith. The Tenant vacated the rental unit as a result of the Landlord's N12 notice, but the Landlord's parents did not move into the unit within a reasonable time after the Tenant vacated.

The ruling

The Tenant's application is granted. The Landlord is ordered to pay the Tenant $5,400 for rent differential and $362.80 for reasonable moving expenses, for a total of $5,812.80 to be paid by March 31, 2022. If the Landlord does not pay the full amount by the due date, the Tenant will be owed interest at 2% annually on the outstanding balance.
