What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective July 31, 2021. The Tenants must pay the Landlord $16,180.10, which includes rent arrears up to July 12, 2021 and the application filing fee, less the rent deposit and interest owed on the deposit. The Tenants must also pay the Landlord $83.84 per day for compensation for use of the unit starting July 13, 2021 until the Tenants move out. If the Tenants do not pay the full amount owing by July 31, 2021, they will start to owe interest, and the Landlord may file the order with the Court Enforcement Office for enforcement of the eviction. If the Tenants pay $20,586.00 on or before July 31, 2021, the eviction order will be void and the tenancy will continue.
