What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was not present at the hearing.
The ruling
The tenancy is terminated effective August 15, 2020. The tenant must move out by that date. The tenant shall pay the landlord $3,135.12, which represents arrears of rent up to March 31, 2020 less the last month's rent deposit and interest on the deposit. The tenant shall also pay the landlord $34.49 per day for compensation for the use of the unit starting August 5, 2020 to the date the tenant moves out, and $175.00 for the cost of filing the application. If the tenant does not pay the full amount by August 15, 2020, the tenant will start to owe interest at 2% annually on the outstanding balance.
