What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective March 6, 2021. Tenants must pay Landlord $8,375.07, which includes rent arrears up to February 23, 2021 less the rent deposit and interest owed. Tenants must also pay $59.18 per day for use of unit from February 24, 2021 until move-out, and $201 application fee. If full amount not paid by March 6, 2021, 2% annual interest will accrue. If unit not vacated by March 6, 2021, Landlord may file order for eviction enforcement.
