What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
The ruling
The tenancy is terminated unless the tenants pay the outstanding rent arrears of $26,686 by January 31, 2023, $29,986 by February 28, 2023, $33,286 by March 31, 2023, or $36,586 by April 1, 2023. If the tenants do not void the order, they must vacate the unit by April 1, 2023 and pay the landlord $21,890.36 plus daily compensation of $108.49 from January 18, 2023 until the date they move out.
