What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The parties had previously agreed to terminate the tenancy effective September 30, 2021 in another Landlord application.
The ruling
The tenancy was terminated effective September 30, 2021. The Tenants were ordered to pay $31,762.26 to the Landlord, which includes rent arrears up to the termination date and the cost of filing the application, less amounts waived by the Landlords. The Tenants were also ordered to pay $108.49 per day in compensation if they did not vacate by September 30, 2021.
