What happened
Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 by failing to remove mould and dirt from the windows and failing to clean the carpets in the rental unit.
The ruling
The Landlord failed to meet its maintenance obligations under section 20(1) of the Act by failing to address the mould in the windows. The Tenants are entitled to $587.60 in reasonable out-of-pocket expenses incurred to rectify this issue. The Landlord was not in breach of its obligations with respect to the carpets.
