What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. Tenant Bout had moved out in February 2020, and Tenant Brum continued to reside in the unit with two minor children.
The ruling
The tenancy is terminated effective March 23, 2021. The Tenants must pay $17,491.91 (less any payments made after November 12, 2020) to the Landlord, which includes rent arrears, compensation, and application filing costs, less the rent deposit and interest. The Tenants must also pay $50.30 per day for compensation for use of the unit starting March 13, 2021 until they vacate. If the full amount is not paid by March 23, 2021, the Landlord may file the order with the Sheriff for enforcement.
