What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit by the hearing date.

The ruling

The tenancy is terminated effective December 22, 2020. The tenant is ordered to pay $7,744.33 to the landlord, which includes rent arrears up to December 11, 2020 and the landlord's filing fee, less the rent deposit and interest on the deposit. The tenant shall also pay $118.03 per day in compensation for the use of the unit from December 12, 2020 to the date the tenant vacates. The order will be void and the tenancy will not terminate if the tenant pays $13,546 on or before December 22, 2020.
