What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlords served an N8 notice on September 10, 2021. The Tenant argued medical issues caused payment difficulties but is now in a better financial position.
The ruling
The Landlord and Tenant Board granted relief from eviction subject to conditions. The Tenants must pay rent on or before the 1st day of each month from October 2022 to September 2023. If the Tenants fail to comply, the Landlords may apply for termination and eviction within 30 days of a breach. The Tenants must also pay the Landlords $201.00 for the application filing cost.
