What happened

The landlord applied for an order to terminate the tenancy and evict the tenants due to their failure to meet the conditions specified in a previous mediated settlement. The tenants did not pay $300 by April 20, 2021 and did not pay the lawful monthly rent by May 1, 2021 as required by the settlement.

The ruling

The tenancy is terminated effective May 29, 2021. The tenants must pay the landlord $19,195.97, which includes rent arrears up to May 18, 2021, less the rent deposit and interest owed on the deposit. The tenants must also pay $46.62 per day for compensation for use of the unit starting May 19, 2021 until they move out. If the full amount is not paid by May 29, 2021, the tenants will owe interest at 2% annually on the outstanding balance.
