What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the total rent they were required to pay from January 1, 2017 to December 31, 2021.
The ruling
The tenancy is terminated effective January 18, 2022. The Tenants must pay the Landlord $2,312.97, which includes rent arrears up to January 7, 2022 and the cost of filing the application, less the amount the Tenants paid. The Tenants must also pay $20.88 per day for compensation for use of the unit from January 8, 2022 until they move out. If the Tenants do not pay the full amount by January 18, 2022, they will start owing interest, and the Landlord can file the order with the Sheriff for enforcement. The Tenants can void the eviction order by paying $2,983.00 on or before January 18, 2022.
