What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
The ruling
The Tenant shall pay the Landlord $17,285.00 for rent arrears and costs. The Tenant shall pay $1,371.00 on or before February 19, 2023, $200.00 on or before April 20 and May 20, 2023, and $360.00 on or before the 20th of each month starting June 20, 2023 until November 20, 2027, with a final payment of $393.00 on December 20, 2027. The Tenant shall also pay new rent on time and in full. If the Tenant fails to make any payment, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
