What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to substantial interference with reasonable enjoyment or lawful rights of the Landlord or other tenants. The issue was the storage of garbage in the front yard. The Landlord requested an order allowing the tenancy to continue on the condition that the Tenant maintains a clean front yard.
The ruling
The tenancy is allowed to continue under the condition that the Tenant refrains from storing garbage in the front yard for twelve consecutive months from October 5, 2022, to October 4, 2023. If the Tenant breaches this condition, the Landlord may apply for termination within 30 days of the breach. The Tenant must pay the Landlord $186.00 for the application filing cost by April 30, 2023.
