What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after the Tenant failed to meet the payment conditions specified in a previous order issued by the Board.
The ruling
The Tenant's motion to set aside the previous order is denied. The stay of the previous order is lifted on June 30, 2021, and the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction starting July 1, 2021. The Tenant cannot be evicted while the stay-at-home order is in place, and eviction by the Sheriff may only occur after the regulation is removed by the Ontario Government.
