What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to their dogs substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Tenants failed to prepare their unit for treatment of cockroaches, causing the infestation to spread, and left dog hair in the laundry machines and permitted their dogs to defecate in the stairwells.
The ruling
The tenancy is terminated effective October 31, 2021. The Tenants must move out by that date. The Tenants shall pay the Landlord $44.40 per day for compensation for use of the unit from October 19, 2021 to the move-out date, and $201 for the cost of filing the application. If the Tenants do not pay the full amount by October 29, 2021, they will owe interest at 2% annually on the outstanding balance starting October 30, 2021. If the unit is not vacated by October 31, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement.
