What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Landlord also claimed NSF cheque charges and related administration charges. The Landlord also applied for an order to terminate the tenancy and evict the Tenant because the Tenant has been persistently late in paying the rent.

The ruling

The tenancy is terminated, and the Tenant must move out by December 3, 2021. The Tenant must pay the Landlord $12,038.29, which includes rent arrears, compensation, NSF cheque charges, and administration charges, less the rent deposit and interest owed on the deposit. The Tenant must also pay the Landlord $33.71 per day for compensation for the use of the unit starting November 23, 2021 until the Tenant moves out. If the Tenant does not pay the full amount by December 3, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
