What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant attempted to raise concerns under section 82 of the Residential Tenancies Act, but was not allowed as they had already filed a separate T2 application. Tenant challenged the lawful rent amount and service of N4 notice, but both were determined to be valid.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $6,306.00 by July 26, 2022. If not voided, the Tenant must move out by July 26, 2022, and pay $4,456.84 to the Landlord. The Tenant shall also pay $22.36 per day for use of the unit from July 8, 2022, until move-out. The eviction may be enforced by the Sheriff starting July 27, 2022, if the unit is not vacated.
