What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant wanted to raise issues under section 82 of the Residential Tenancies Act, 2006 but did not comply with the disclosure requirements. The Tenant is in arrears of over $42,000 in rent and the Board found it would be unfair to grant relief from eviction.
The ruling
The tenancy is terminated effective May 22, 2021. The Tenant must pay $35,000 to the Landlord, plus $55.89 per day starting May 12, 2021 until the Tenant vacates. The Tenant can void the eviction order by paying $42,675 by May 22, 2021.
