What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective February 15, 2021 unless the Tenant pays $4,648.00 to the Landlord or to the Board in trust by that date to void the eviction order. If the Tenant does not make this payment, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant must also pay the Landlord $2,756.74 (less any payment made after December 2, 2020) for rent arrears and compensation, as well as $175.00 for the application filing costs. The Tenant will also owe $28.77 per day in compensation starting February 5, 2021 until they move out.
