What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants had accrued rent arrears from June 2019 to November 2020 due to the Tenant's illness and financial hardship during the COVID-19 pandemic. The Tenants proposed a 6-month payment plan to pay the arrears, which the Landlord did not initially agree to.

The ruling

The Landlord's application for eviction was denied on the condition that the Tenants make a payment plan to pay the $8,747 in rent arrears and application fee, in addition to paying the monthly rent. If the Tenants fail to make the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenants.
