What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after the Tenant failed to meet a condition specified in a previous mediated settlement. The Tenant filed a motion to set aside the eviction order.

The ruling

The eviction order was set aside, and the previous mediated settlement was cancelled and replaced with a new order. The Tenant is required to pay the remaining $565.00 arrears in three installments by November 20, 2020, and to pay the monthly rent on time for 12 months starting October 1, 2020. If the Tenant fails to make any of the required payments, the Landlord may apply to the Board for an order terminating the tenancy and evicting the Tenant.
