What happened
Landlord applied for an order requiring Tenant to pay the rent that the Tenant owes. The Tenant was in possession of the rental unit, and the lawful monthly rent was $1,850.00. The Landlord claimed the Tenant did not pay the rent for May 2021, but the Tenant paid the rent for May 2021 in full on the day the Landlord filed the application. The Tenant also paid the rent for June, July, and August 2021 after the application was filed. The Tenant gave notice that they would be vacating the rental unit on September 30, 2021, and the Landlord collected a last month's rent deposit of $1,850.00 which was credited to the month of September 2021. As a result, the Tenant was not in arrears.
The ruling
The Landlord's application is dismissed as the Tenant is not in arrears.
