The ruling

The Residential Tenancies Act, 2006 does not apply to this living situation as the property consists of a restaurant on the main floor and a three-bedroom residential unit on the second floor, both of which are under a single lease agreement and occupied by the same person (the Tenant). Therefore, the Board does not have jurisdiction to hear the Tenant's application.
