What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Davis Pelletier vacated the rental unit on June 30, 2020, prior to the hearing date.
The ruling
The tenancy is terminated as of June 30, 2020, the date the Tenant Davis Pelletier gave vacant possession of the rental unit to the Landlord and the date when the Landlord entered into a new tenancy agreement with Victoria Stephen. The Tenants shall pay to the Landlord $2,668.83, which represents the amount of rent owing and compensation up to June 30, 2020, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenants shall also pay to the Landlord $175.00 for the cost of filing the application. If the Tenants do not pay the Landlord the full amount owing on or before March 8, 2021, the Tenants will start to owe interest.
