What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The tenancy is terminated effective February 27, 2021 unless the Tenant pays $3,925.00 to the Landlord or to the Board in trust by that date to void the eviction order. If the Tenant does not make this payment, the Tenant must move out by February 27, 2021 and pay the Landlord $2,419.39 plus $31.23 per day from February 17, 2021 until the Tenant moves out. The Tenant must also pay the Landlord $175.00 for the cost of filing the application.
