What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenants did not void. One Tenant vacated in September 2022, and the other Tenant passed away on January 8, 2023.

The ruling

The tenancy was terminated effective February 7, 2023, due to the death of one Tenant and the prior move-out of the other. The Tenants' estate is ordered to pay $6,315.03 to the Landlord, which includes rent arrears up to the termination date and the cost of filing the application, minus the rent deposit and interest on the deposit.
