What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served a valid N8 notice of termination with a termination date of April 30, 2022. Since the N8 notice was served, the Tenant continued to pay rent late each month from March 2022 to November 2022.

The ruling

The tenancy is terminated, and the Tenant must move out by December 19, 2022. The Tenant owes the Landlord $5,886.71, less any payments made, which includes compensation for use of the unit, filing fees, and interest on the rent deposit. If the Tenant does not pay the full amount by December 19, 2022, they will start owing interest at 4% annually on the outstanding balance.
