What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to pay rent as per a previous mediated settlement agreement. The Tenant filed a motion to set aside the previous order.

The ruling

Given the Tenant's failure to pay the arrears and rent pursuant to the previous agreement, and the Tenant's steady income through Ontario Works without paying rent as it came due, the stay of the previous order was lifted effective September 15, 2020 to allow the Tenant some time to find alternative accommodations and for his daughter to further recover before moving.
