What happened
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.
The ruling
The tenancy is terminated as of May 4, 2021, and the Tenants must move out on or before March 31, 2022. The Tenants shall pay the Landlord $5,779.58, which represents compensation for the use of the unit from May 5, 2021 to December 20, 2021, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenants shall also pay the Landlord $30.44 per day for compensation for the use of the unit from December 21, 2021 to the date they move out. If the Tenants do not pay the full amount owing by March 31, 2022, they will start to owe simple interest at 2.00% annually on the balance outstanding.
