What happened

Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords require possession of the rental unit for the purpose of residential occupation. The Tenant argued the N12 notice was served in bad faith, but the Board found the Landlords did not serve the notice in bad faith and they require the unit in good faith.

The ruling

The tenancy is terminated as of July 31, 2022, and the Tenant must vacate the unit by that date. If the unit is not vacated by July 31, 2022, the Landlords may file the order with the Court Enforcement Office for enforcement starting August 1, 2022. The Tenant may terminate the tenancy earlier with 10 days' written notice to the Landlords.
