What happened

Landlord filed L1 and L2 applications to terminate tenancy and evict Tenant for non-payment of rent, persistent late payment, and substantial interference. The main issue was the presence of two large dogs in the rental unit, which were prohibited by the tenancy agreement but required as service animals for the Tenant's girlfriend's medical conditions.

The ruling

The tenancy is terminated effective April 30, 2016, unless the Tenant voids the order by paying the specified amounts. The Tenant must pay $2,909.35 for rent arrears and compensation, plus $48.49 per day from April 1, 2016, until move-out. The Tenant can void the eviction by paying $4,595.00 by March 31, 2016, or $6,070.00 by April 30, 2016. If the Tenant voids the order, they must pay rent on time for 12 consecutive months. The application regarding the dogs is dismissed due to medical necessity.
