What happened
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Tenants argued that the Landlord did not pay the required one month's rent compensation when serving the N12 notice.
The ruling
The Landlord's application is dismissed. The Tenants shall return the $950.00 compensation to the Landlord by March 31, 2022. If the Tenants do not pay the full balance by March 31, 2022, they will owe 2% simple interest on any outstanding balance starting April 1, 2022.
