What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective August 1, 2023. The tenant must vacate the rental unit by that date. If the unit is not vacated, the landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement starting August 2, 2023. The tenant owes $2,744.40 to the landlord, which includes rent arrears up to May 31, 2023 and the cost of filing the application, minus the rent deposit and interest on the deposit. If the tenant pays the June and July 2023 rent in full and on time, the landlord will waive the $2,744.40 amount. If the tenant fails to pay the June and/or July rent, the full amount will become due immediately and the tenant will owe interest.
