What happened
Landlord applied for an order to terminate the tenancy and evict Tenant based on the Tenant having committed an illegal act at the rental unit by growing more cannabis plants than he is permitted for personal consumption. The Tenant acknowledged that he had more cannabis plants in the rental unit than he was legally permitted to grow.
The ruling
The Tenant shall not have in the rental unit or on the property owned by the Landlord and adjacent to the rental unit cannabis plants in excess of the number that he is permitted by law to have for personal consumption, unless he obtains a permit or license that permits him to do so, for a period of twelve (12) months commencing on May 30, 2021. If the Tenant fails to comply, the Landlord may, within 30 days and without notice to the Tenant, apply under section 78 of the Act for an order terminating the tenancy and evicting the Tenant. The Tenant shall pay the Landlord's filing fee of $186.00 by May 31, 2021. If the Tenant does not pay the $186.00 by that date, the Tenant will be liable to pay simple interest at 2% per annum from 31 May 2021.
