What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears.

The ruling

The tenancy is terminated unless the Tenants void the order by paying $19,026 by January 31, 2023 or $20,596 by February 4, 2023. If the Tenants do not void the order, they must pay the Landlord $16,373.38 and vacate the unit by February 4, 2023. The Landlord is entitled to daily compensation of $51.62 for the Tenants' continued occupation after January 11, 2023.
