What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. Ken Garton had vacated the rental unit before the application was filed, so he was removed as a party.

The ruling

The tenancy is terminated effective April 19, 2021. The Tenant must pay the Landlord $26,342.45, plus $29.59 per day starting April 9, 2021 until the unit is vacated. If the Tenant pays $27,030 on or before April 19, 2021, the eviction order will be void and the tenancy will continue.
