What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit prior to the hearing date.

The ruling

The tenants are ordered to pay $12,210.35, plus $28.45 per day starting December 1, 2020, to the landlord, which includes rent arrears up to the termination date and the cost of filing the application. The tenants can void the eviction order by paying $13,108.30 on or before November 30, 2020, or $13,973.60 after November 30, 2020 but on or before December 11, 2020.
