What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Tenant had been late paying rent 10 times in the last 17 months and 17 times over the past 24 months. The Landlord had also served 7 N4 Notices for non-payment of rent within the last 18 months.
The ruling
The tenancy is terminated effective March 5, 2022. The Tenant must vacate the unit by that date. The Tenant is ordered to pay the Landlord $5,575.42, which includes compensation for use of the unit from November 1, 2021 to February 22, 2022, less the rent deposit and interest owed on the deposit. The Tenant must also pay $67.73 per day from February 23, 2022 until the unit is vacated, as well as the $186 application fee. If the Tenant does not pay the full amount by March 5, 2022, they will owe interest at 2% annually on the outstanding balance.
