What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant remained in possession of the rental unit on the application date.

The ruling

The tenancy is terminated effective January 5, 2021 unless the tenant pays $3,664 by December 31, 2020 or $4,015 by January 5, 2021 to void the order. If the tenant does not make full payment by the deadlines, the landlord may file the order with the Sheriff to enforce the eviction. The tenant must also pay $2,720.90 in rent arrears and application costs, plus $11.54 per day in compensation starting December 25, 2020.
