What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Tenant (AL) advised that Tenant (CS) is no longer an occupant of the rental unit and has not lived there for more than 12 months. The Tenant (AL) testified that due to COVID, her employment has been impacted, and because of a marital separation, she was not receiving full financial support for her 3 children.
The ruling
The Tenant shall pay the current lawful monthly rent of $1,232.70 in full and on time, on or before the 1st day of each month for the next 12-month period commencing January 1, 2022 through to and including December 1, 2022. If the Tenant fails to make any one of the payments, the Landlord may apply under section 78 of the Act, without notice to the Tenant for an order terminating the tenancy and evicting the Tenant. The Tenant shall also pay $151.20 to the Landlord, the balance outstanding of the Landlord's filing fee on or before December 15, 2021. If the Tenant does not pay the Landlord the full amount owing on or before December 15, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding.
