What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit by the hearing date.

The ruling

The tenancy is terminated effective November 30, 2021. The tenant is ordered to pay $751.02 to the landlord, which includes rent arrears up to November 4, 2021 and the application filing fee, less any payments made since the hearing date. The tenant must also pay $7.33 per day for compensation for use of the unit from November 5, 2021 until the move-out date. If the tenant pays $904 on or before November 30, 2021, the eviction order will be void and the tenancy will continue.
