What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.

The ruling

The Tenant shall pay the Landlord $3,766 for rent arrears and costs owing through January 31, 2023. The Tenant shall pay $100 by the last day of each month during the period February 28, 2023 to March 30, 2026, and $66 by April 30, 2026. The Tenant shall also pay the monthly rent on time until the arrears are paid in full. If the Tenant fails to make any payment, the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
